Municipal Court
The court is situated inside the City of Whitewater Municipal Building. Court sessions take place on various dates and times, depending on the specific proceedings. Initial appearances are scheduled for 2:30 p.m. every other Wednesday.
Office Hours are Monday through Friday, 9:00 a.m. to 2:00 p.m.
You can enter a Not Guilty Plea in writing before the court date by email at Clerk of Whitewater Municipal Court, OR by mail at P.O. Box 690, Whitewater, WI 53190, OR in person at 312 W. Whitewater St., Whitewater, WI 53190. Please provide your name, address, phone number, email, and citation number(s) on your request. Upon entering your not guilty plea a notice will be mailed to you and you will need to contact the City Attorney’s office to schedule a pretrial conference at a later date and time.
Payment of your citation prior to the court date will be treated as a No Contest Plea unless you specify otherwise in writing or by appearance at your court hearing, and the Court will treat this No Contest Plea as a Guilty Plea for purposes of judgment.
If you wish to request a new court date, you may request a one-time continuance prior to the court date by phone, email, or mail. A new initial appearance date will be given.
IF YOU DO NOTHING, you will be found guilty by default and given 60 days to pay in full. See the section on Default Judgments below for more details.
If your appearance is marked "MANDATORY", the same options stated above will apply to you but you are still required to appear unless the Court states otherwise. Please contact the Clerk of Court for additional possible options and/or consequences.
We ask that if you do appear, you do not bring along any additional parties except those necessary, and/or a parent or guardian if required.
PLEASE NOTE: When considering your options above, with minimal exceptions, the Judge cannot amend your citation at your initial appearance. If you wish to contest your citation or discuss anything regarding your citation, please consider entering a Not Guilty plea in writing prior to the court date as stated above and you will be scheduled for a pretrial conference with the City attorney at a later date.

Citation Procedures
After Receiving Your Citation
You must either:
Post bond and/or enter plea by mail
- Appear in court on your court date at your Initial Appearance on your assigned court date
- Pay the forfeiture prior to your court appearance (and by doing so, entering a No Contest Plea)
- Enter a Not Guilty Plea in writing by mail, or in person with the Clerk of Courts before your initial appearance
Plea Types
- Not Guilty -Must be entered in writing before your court date, or in person during your court appearance
- Guilty
- No Contest- Treated as a Guilty plea for judgement purposes
Default Judgement
Failure to appear in Court without posting bond shall result in a default judgment being entered against you. The Court shall treat your failure to appear as an admission of guilt, find you guilty, and may impose any amount of forfeiture or other penalties against you as allowed by law.
A default judgment amount may be MORE or LESS than the bond amount stated on the citation.
Payment
You can post/pay the bond amount listed on your citation online, by mail, or in person instead of appearing in court. If you do so, the Court will treat this payment as a No Contest plea unless you enter a different plea in writing or by appearing for your Initial Appearance.
When paying by mail, send a certified check or money order made payable to "Whitewater Municipal Court" to the address listed.
Credit card payments can be made online.
In-person payments may be made by cash, credit card, or check at the Clerk of Court’s office.
Failure to pay the fine or forfeiture against you, or meet any other requirements of your judgment, may result in your driving privileges being suspended for up to one (1) year, and the Court may issue a warrant for commitment to jail be issued against you for continued nonpayment. The Court may also seek to collect the unpaid fines, fees, or forfeitures through a collection agency and an assignment of wages.
